0. Document stack — what's current, what's superseded

The "Child Care Centres Regulations" (Cap. 37A, Rg 1, 2012 Ed.) is REVOKED. The ECDC Regulations 2018 refer to it explicitly as "the revoked Child Care Centres Regulations" (Fifth Schedule, ¶6). Its figures (e.g. 5 sqm for ≤18-month-olds, a 30 sqm/one-fifth-capacity outdoor-space rule, a stepped toilet table, "every centre shall be housed on the ground floor unless otherwise approved") are obsolete and conflict with current rules — never quote them.

Current, controlling stack:

  1. ECDC Act 2017 — the primary legislation (licensing power, offences, licence lapse/transfer).
  2. ECDC Regulations 2018 (S 890/2018) — the binding numeric requirements (fees, Sixth Schedule premises rules, Seventh Schedule sanitary ratios).
  3. ECDC Code of Practice, 5th Edition (2026) — ECDA's operational standard, issued under Act s36; breach is itself a ground for regulatory action (s16(1)(a)(iii)). Where the CoP and the Guide differ, the CoP governs.
  4. Guide to Setting up an ECDC — walks through the practical steps; its body text is dated 11 Jun 2020 despite the "(Oct25)" filename Andrea supplied it under — treat the CoP as controlling on any inconsistency.

1. Licensing pathway, timeline, fees

Sequence (Guide §3.4.1): site-authority approval (URA for private commercial/residential, HDB for void-deck/commercial, SLA for state land, NEA for B1/Business Park) → tenancy agreement → URA Approved Use / Change of Use / Grant of Written Permission → BCA Certificate of Statutory Completion or TOP → SCDF Fire Safety Certificate or Temporary Fire Permit → LTA carpark clearance if needed → PUB sanitary clearance if adding fittings beyond the existing count → ECDA licence application (GoBusiness Licensing Portal, documents via ONE@ECDA/CMS) → on-site visit by an ECDA Licensing Officer → approval.

2. Premises sizing — capacity formula

Computed only on dedicated teaching/learning area — EXCLUDES toilets, pantry, kitchen, office, store, sick bay, staircase landings and corridors (CoP ¶2.2.2; the Guide's version omits the landing/corridor exclusion — the CoP is stricter and controls). Each teaching/learning activity area must be ≥12 sqm. Usable area must be fully enclosed and weatherproof — an open balcony or car porch does not count.

The binding constraint is usually OUTDOOR space, not indoor floor area. A Class B centre needs safe access to outdoor gross-motor-area (GMA) space equal to ≥1/6 of capacity at 4 sqm/child, or 40 sqm, whichever is more; Class C needs ≥1/10 at 4 sqm/child, or 40 sqm, whichever is more (Guide §3.4.2(c); CoP ¶2.2.6–2.2.7). If no compliant outdoor GMA space is available, the indoor area is excluded from the capacity computation entirely — the application is rejected. This is the single most important premises gate to confirm with a landlord/seller before quoting any capacity figure. Worked example (indicative only): on a gross unit area of ~450 sqm, after typical service-area deductions (toilets, kitchen, office, sick bay, corridors), teaching area lands roughly 60–70% of gross (~270–315 sqm). At the Class B ratio that is ~90–105 children; at Class C, ~145–170; at Class A, ~54–63 infants — all before checking the outdoor-GMA gate above. Always label a figure like this "indicative — subject to ECDA/CLO approval and confirmed outdoor space", never a promised headcount.

4. Sanitary + mandatory rooms

Sanitary ratios (ECDC Regs 2018, Seventh Schedule — the legally binding version): minimum 2 wash-hand basins + 2 flush toilets per centre; ratio ≥1:23 children to both basins and toilets (i.e. 5 of each at 100 children); toilets child-sized, pedestal, ≤400 mm bowl height, individually partitioned, ≥1 cubicle with a door/curtain; full-day service needs bathing facilities with water heaters, ≥1 shower per 50 children; infant classes need 1 sink + 1 diaper-changing area per 10 infants, changing table with raised sides next to a running-water sink. Toilet facilities are required at every level/bay of the premises.

Mandatory rooms (Sixth Schedule ¶3, all required): class area; food-preparation area not accessible by any child; indoor activity area; a designated play area; toilet and bath facilities; kitchen utensil-washing area; dining area; rest area; staff office area; staff rest area; a fully enclosed sick bay for isolating a sick child (corridors, pantry, kitchen, storeroom or toilets don't qualify); and separate storage for food, beds/bedding, toys, indoor and outdoor play equipment, and medical supplies. A haze space with air purifiers accommodating ≥50% of maximum capacity is also required.

Location: B2 industrial premises are prohibited outright ("child health & safety" — B2 is a hard no). B1/Business Park is case-by-case, needs NEA approval + URA change of use, and the operator must sit on the building's Fire Safety Committee with an Incident Management Plan (+ up to 3 months' extra processing). No petrol-station/road-setback distance rule exists in current law (that was in the now-revoked 2012 regs; the current CoP only regulates road-crossing between bays for multi-bay centres).

5. Operator side (brief — for context, not the premises focus)

Three licence classes: A (infant, 2–18mth), B (childcare, 18mth–<7yr, Mon–Fri+half-Sat, ≥12hrs/day), C (kindergarten, 18mth–<7yr, Mon–Fri only, MOE calendar, ≤6hrs/day, half-day sessions). A licensee may hold A-only, B-only, C-only, A+B, or A+C — never B+C together. Children may not stay >24 continuous hours. Staff-child ratios run roughly 1:5 for infants (with ≥2 staff present at all times) down to 1:20 for older groups (Guide §3.5). Fit-out-relevant CoP obligations: secured entry/exit with logging; CCTV allowed in play areas but prohibited in toilets, changing rooms and staff rest areas; 6-monthly evacuation exercises with a separate written infant-evacuation procedure; the floor plan must be QP-certified and titled for the actual use ("childcare centre"/"kindergarten") — a floor plan approved for a commercial school or education centre will NOT be accepted.

Every figure in this file is either a fixed legal requirement (cite the Act section, Regulation schedule, or CoP paragraph as shown above) or an ECDA-published planning guideline that the Chief Licensing Officer applies with discretion (capacity, tenure length, timeline, above-ground-floor conditions). Never state a capacity figure, a licensing timeline, or "the licence transfers with the unit" as settled fact in any public-facing copy — always "indicative, subject to ECDA/CLO approval", and flag the outdoor-GMA-space question to Andrea explicitly for any upper-storey or non-obviously-outdoor-adjacent unit, since it alone can zero out an otherwise generous floor-area capacity.
